In a significant ruling for the commercial real estate sector, Advocates Bureau YUG has successfully defended a Moscow-based leasing and property management firm in a high-stakes dispute involving title registration and the integrity of the Unified State Register of Real Estate Rights (EGRP).
The litigation arose when the client was joined as an interested party in a lawsuit challenging the governments refusal to register ownership rights for a non-residential premises in Moscow. The plaintiff sought to overturn the regulatory denial and restore an ownership record in the EGRP. The core of the dispute involved a "duplication" of property records. The client, who held clear legal title to a similar premises, found its interests threatened when the plaintiff attempted to register rights to a property that overlapped with the clients existing holdings.
During the initial proceedings, evidence emerged that the Federal Service for State Registration, Cadastre and Cartography (Rosreestr) had suspended the plaintiffs registration specifically because of this duplication. Despite the plaintiffs failure to rectify the underlying issues identified by the regulator, the district court initially ruled in the plaintiffs favor, labeling the governments refusal as unlawful.
On appeal, Advocates Bureau YUG challenged the lower courts disregard for these procedural hurdles. The Krasnodar Regional Court ultimately sided with the defense, overturning the first-instance decision. The appellate court found that Rosreestr acted lawfully in denying the registration, noting that the plaintiffs claims essentially duplicated the physical characteristics and documentation of the clients non-residential premises.
The victory ensures the clients title remains unencumbered by duplicative or conflicting administrative claims. The client was represented throughout the proceedings by lawyer Ekaterina Fedenko.
